Third-Party DNS Functionality ("Ultimate Uptime Anycast DNS") Terms
This Third-Party DNS Functionality Terms for Anycast DNS from Gransy Agreement ("Agreement") sets forth the terms and conditions applicable when You elect to access third-party Anycast DNS functionality, also known as "Ultimate Uptime Anycast DNS", through the Trustname platform.
Fewmoretaps OÜ doing business as Trustname ("Trustname") is a domain name registrar. Trustname does not own, operate, maintain or control the underlying authoritative DNS infrastructure used to answer DNS queries under this Agreement. The authoritative DNS infrastructure made accessible through the Trustname platform is operated by Gransy s.r.o., Czech Republic ("DNS Operator" or "Operator").
Trustname may provide account-level access, configuration functionality and technical integration that enables You to submit DNS configuration instructions to the Operator. The availability of DNS record management within a Trustname account does not mean that Fewmoretaps OÜ operates or provides the underlying authoritative DNS resolution service.
In this Agreement, "You" and "Your" refer to You as the customer or any person authorized to act on Your behalf. "We", "Us" and "Our" refer solely to Trustname unless the context expressly identifies the DNS Operator.
This Agreement supplements the and other applicable Trustname policies and agreements. In the event of a conflict concerning the underlying authoritative DNS infrastructure, this Agreement controls with respect to the distinction between Trustname's role and the role of the DNS Operator.
1. Definitions.
Unless otherwise specified, capitalized terms used in this Agreement have the meanings set forth below.
- "Authoritative DNS" means the infrastructure and functionality used to answer authoritative DNS queries for a Domain Name.
- "Customer Zone" means DNS zone information and Resource Records configured by You through functionality made accessible through the Trustname platform.
- "DNS" means the Domain Name System used to resolve domain names and other DNS resource information.
- "DNS Operator" or "Operator" means Gransy s.r.o., Czech Republic, as the independent third party operating the authoritative DNS infrastructure made accessible through the Trustname platform.
- "DNS Query" means a request received by authoritative Name Servers for information relating to a Customer Zone.
- "DNSSEC" means Domain Name System Security Extensions used to authenticate DNS data through cryptographic signatures.
- "Name Servers" means the authoritative name servers and associated systems operated by the DNS Operator for answering DNS Queries.
- "Resource Record" means an individual DNS record contained within a Customer Zone, including records such as A, AAAA, CNAME, MX, TXT, NS, CAA and other supported DNS record types.
- "Third-Party DNS Functionality" means the DNS configuration and related functionality made accessible to You through the Trustname platform while the underlying authoritative DNS infrastructure is operated by the DNS Operator.
2. Nature of the Third-Party DNS Functionality.
Trustname does not itself operate the authoritative DNS resolution infrastructure covered by this Agreement.
Where You elect to use Third-Party DNS Functionality, Trustname provides a technical interface through which You may create, modify or remove supported DNS configuration instructions. Those instructions may be transmitted to systems operated by the DNS Operator for implementation within the Operator's authoritative DNS infrastructure.
Authoritative DNS responses are generated and served by infrastructure operated by the DNS Operator and not by Fewmoretaps OÜ.
For the avoidance of doubt, registrar-level functions performed by Trustname, including configuring nameserver delegation at the applicable Registry or submitting DNSSEC-related Registry information, are separate from operating authoritative DNS resolution infrastructure.
3. Independent DNS Operator.
The authoritative Anycast DNS infrastructure currently made accessible through the Trustname platform is operated by Gransy s.r.o.
Trustname does not own, operate, maintain or control the Operator's authoritative name-server network, Anycast routing infrastructure, network capacity, geographic DNS nodes or other infrastructure used by the Operator to answer DNS Queries.
The Operator may modify its infrastructure, routing, supported functionality, technical requirements, capacity or service availability independently of Trustname.
Trustname may replace, remove or discontinue integration with a particular DNS Operator where reasonably necessary, subject to applicable law and any contractual obligations expressly undertaken by Trustname.
4. Customer Obligations.
You are responsible for:
- creating, reviewing and maintaining accurate DNS Resource Records;
- ensuring that Your DNS configuration is appropriate for Your Domain Name and associated services;
- maintaining appropriate backups or copies of important DNS configuration information;
- ensuring that You have authority to configure DNS for the applicable Domain Name;
- reviewing DNS changes before submitting them through the Trustname interface;
- maintaining appropriate account security and protecting Your Trustname account credentials;
- ensuring that DNS configuration does not violate applicable law, this Agreement or other applicable Trustname policies; and
- migrating to another DNS provider before discontinuing use of the Third-Party DNS Functionality where continuity of DNS resolution is important to You.
5. Trustname's Role.
Trustname's role is limited to providing account-level access, configuration functionality, technical integration and, where applicable, registrar-level nameserver or DNSSEC configuration.
Trustname may transmit Your DNS configuration instructions and related technical information to the DNS Operator where necessary to make the Third-Party DNS Functionality available.
Trustname does not independently answer authoritative DNS Queries and does not assume operational control over the DNS Operator's authoritative infrastructure merely because DNS configuration functionality is accessible through a Trustname account.
6. Permission To Use.
Subject to this Agreement, Trustname grants You a limited, non-exclusive, non-transferable right to access the DNS configuration functionality made available through Your Trustname account.
You grant Trustname the limited right to process and transmit Customer Zone information and related technical instructions where reasonably necessary to provide the Trustname interface and facilitate configuration with the DNS Operator.
Nothing in this Agreement transfers ownership of the DNS Operator's infrastructure, software, network, intellectual property or systems to Trustname or to You.
7. Protection of Infrastructure.
Trustname may restrict, suspend or disable access through the Trustname platform to Third-Party DNS Functionality where reasonably necessary to protect Trustname systems, comply with applicable law, respond to abuse, address security risks, or comply with technical restrictions imposed by the DNS Operator.
The DNS Operator may independently restrict or suspend its infrastructure or services in accordance with its own operational, security, abuse-prevention or legal requirements.
8. Effect of Termination or Discontinuation.
If Third-Party DNS Functionality is terminated, suspended or discontinued, You are responsible for arranging alternative authoritative DNS service and, where necessary, updating the nameservers delegated for Your Domain Name.
Where Your Domain Name is registered with Trustname, Trustname may provide registrar-level functionality allowing You to change the delegated nameservers. Where the Domain Name is registered with another registrar, You must make the necessary delegation changes through that registrar.
Trustname does not guarantee that DNS data maintained within third-party infrastructure will remain available following termination or discontinuation of the applicable third-party functionality.
9. Representations & Warranties.
You represent and warrant that You have all rights, permissions and authorizations necessary to configure the relevant Customer Zones and Domain Names and that Your use of the Third-Party DNS Functionality will comply with applicable law and Trustname's applicable policies.
You must not use Third-Party DNS Functionality for unlawful activity or in a manner that creates a material security, stability or abuse risk for Trustname, the DNS Operator, other customers or third parties.
10. Third-Party Infrastructure; Disclaimers.
YOU ACKNOWLEDGE THAT THE UNDERLYING AUTHORITATIVE DNS INFRASTRUCTURE IS OPERATED BY AN INDEPENDENT THIRD PARTY AND IS NOT OPERATED OR CONTROLLED BY FEWMORETAPS OÜ.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THIRD-PARTY DNS FUNCTIONALITY MADE ACCESSIBLE THROUGH THE TRUSTNAME PLATFORM IS PROVIDED ON AN "AS IS", "AS AVAILABLE" AND "WHERE AVAILABLE" BASIS.
TRUSTNAME MAKES NO INDEPENDENT WARRANTY CONCERNING THE AVAILABILITY, CAPACITY, GEOGRAPHIC ROUTING, PERFORMANCE OR CONTINUOUS OPERATION OF INFRASTRUCTURE OPERATED BY THE DNS OPERATOR.
Nothing in this Section excludes or limits liability that cannot lawfully be excluded or limited under applicable law.
11. Data Transmission to the DNS Operator.
Where You use Third-Party DNS Functionality, Trustname may transmit Customer Zone information, DNS configuration instructions and limited associated technical information to the DNS Operator where reasonably necessary to configure or administer the functionality.
Personal data processed by Trustname remains subject to the .
The DNS Operator may also process technical or operational information in connection with operation of its own infrastructure and in accordance with applicable law.
12. Compliance With Law.
Each party shall comply with applicable laws and regulations relevant to its respective activities under this Agreement.
Trustname may restrict or discontinue access to Third-Party DNS Functionality where required by applicable law, binding legal process, regulatory requirements, Registry or registrar obligations, security considerations, abuse-prevention requirements or requirements imposed by the DNS Operator.
13. Fees and Billing.
Third-Party DNS Functionality may be made available without a separate charge or may be included with another Trustname product or account feature.
If Trustname expressly charges a separate fee in connection with access to Third-Party DNS Functionality, such fee relates to the functionality, administration or access made available through the Trustname platform unless expressly stated otherwise. The imposition of such a fee does not mean that Fewmoretaps OÜ operates the underlying authoritative DNS infrastructure.
Any applicable refund rights are governed by the .
14. Service Availability.
Trustname does not provide an independent service-level commitment or uptime guarantee for authoritative DNS infrastructure operated by the DNS Operator unless Trustname expressly agrees otherwise in a separate written agreement.
The availability and performance of authoritative DNS resolution may depend upon infrastructure, networks, routing and systems outside Trustname's ownership or operational control.
Trustname may provide information concerning technical characteristics, geographic distribution, performance or availability published by the DNS Operator. Such information describes the third-party infrastructure and does not constitute an independent Trustname guarantee unless expressly identified as such.
15. Suspension or Discontinuation.
Trustname may suspend or discontinue access to Third-Party DNS Functionality where the DNS Operator suspends or discontinues the underlying functionality, where the integration becomes technically unavailable, or where Trustname reasonably determines that continued access presents a legal, regulatory, operational, security or abuse risk.
Where reasonably practicable, Trustname may provide notice of a material discontinuation so that You can configure alternative authoritative DNS service.
16. Customer Choice of DNS Provider.
You are not required to use the Third-Party DNS Functionality made accessible through Trustname.
You may use any compatible independent authoritative DNS provider by configuring the applicable nameservers for Your Domain Name, subject to Registry requirements and applicable law.
Your choice to use another authoritative DNS provider does not affect Trustname's role as registrar for a Domain Name registered with Trustname.
17. Changes to the DNS Operator or Functionality.
Trustname may change the third-party DNS operator or the technical integration used to make Third-Party DNS Functionality accessible through the Trustname platform.
If the identity of the underlying DNS Operator changes materially, Trustname may update this Agreement or other applicable disclosures accordingly.
18. Survival of Terms.
Provisions which by their nature should survive expiration, discontinuation or termination of this Agreement shall survive, including provisions concerning limitations, disclaimers, data processing, intellectual property, record retention, accrued rights and applicable liability.
