Two-Tier Privacy Service Terms
These Two-Tier Privacy Service Terms ("Privacy Terms") apply when Trustname enables its two-tier privacy configuration for an eligible domain. They supplement the Universal Terms of Service, Domain Registration Agreement and, where Suggested Default Contact is used, the Suggested Default Contact Proxy Service & Domain License Agreement.
1. Two Distinct Privacy Layers
1.1 Proxy Layer. Perfect Privacy LLC acts as the Proxy Service Provider and Registered Name Holder. The end customer is the P/P Customer/licensee.
1.2 Privacy Layer. WHOIS Privacy Protection Service LLC (WHOISPPS) supplies alternative reliable public contact information and communication relay functionality for the Registered Name Holder. WHOISPPS is not the Registered Name Holder and does not receive registrant-of-record status merely because WHOISPPS contact data appear in RDAP/RDDS.
2. No End-Customer Personal Data to WHOISPPS
2.1 Trustname does not provide WHOISPPS with the end customer's underlying personal registration data for the purpose of operating the Privacy Service. Trustname retains such data in its own registrar records and handles any required escrow, registry transfer, lawful disclosure or verification processing.
2.2 WHOISPPS may process operational information necessary to supply its public contact mechanisms, routing identifiers and service administration, but this does not change the parties' registration roles.
3. Public Registration Data
3.1 The public registration-data response may contain WHOISPPS alternative reliable address, telephone and relay-email data where permitted by the applicable TLD implementation. To preserve the Privacy Service structure, Perfect Privacy LLC remains the Registered Name Holder. WHOISPPS must not be presented as the domain owner or registrant of record solely as a consequence of the Privacy Service.
3.2 RDAP/RDDS output is subject to applicable ICANN Registration Data Policy requirements, registry capabilities, applicable law and technical implementation. Trustname may modify the displayed privacy contact format when necessary to remain compliant.
4. Communications
4.1 WHOISPPS may receive communications at the contact mechanisms it supplies and may relay or make them available to Trustname. Trustname may relay appropriate communications to the customer or other relevant recipient in accordance with the published Privacy & Proxy Service Procedures.
4.2 Unsolicited commercial communications, bulk mail, malware, abusive material and communications unrelated to the protected domain may be discarded or not relayed.
5. Service Removal
5.1 The Privacy Service may be removed if WHOISPPS ceases providing the service, a domain/TLD is ineligible, a registry or applicable policy requires a different configuration, a binding legal obligation requires removal, the applicable agreement is materially breached, or Trustname reasonably determines that an alternative implementation is required for compliance or system integrity.
5.2 Removal of the WHOISPPS layer does not by itself terminate the Perfect Privacy LLC Proxy Service unless Trustname separately confirms termination of that Proxy Service.
6. Pricing
6.1 The Privacy Service is currently included at US$0 additional charge with eligible registrations unless the checkout page or pricing page expressly states otherwise.
7. Third-Party Provider Relationship
7.1 WHOISPPS provides its service to Trustname under a registrar-level service arrangement. Unless expressly agreed otherwise in writing by WHOISPPS, the end customer is not a party to the Trustname-WHOISPPS agreement and has no third-party beneficiary rights under that agreement.
8. Provider Information
WHOISPPS business contact information, support details and abuse/infringement reporting channels are published in the Trustname Privacy & Proxy Service Public Procedures. These Privacy Terms are governed by the Trustname Universal Terms of Service.
