DSA Notice & Action Mechanism: Submission Guidelines
As a hosting provider under the Digital Services Act (DSA), Trustname has established a Notice & Action Mechanism for reporting content hosted by Trustname where such content is believed to be illegal under applicable European Union (EU) law and/or the law of an EU Member State.
DSA Requirements for Submission
To help you submit a compliant notice, below are the elements required by Article 16 of the Digital Services Act:
- (a) A sufficiently substantiated explanation of the reasons why the individual or entity alleges the information in question to be illegal content.
- (b) A clear indication of the exact electronic location of that information, such as the exact URL or URLs, and, where necessary, additional information enabling the identification of the illegal content adapted to the type of content and to the specific type of hosting service.
- (c) The name and email address of the individual or entity submitting the notice, except in cases involving offences referred to in Articles 3 to 7 of Directive 2011/93/EU.
- (d) A statement confirming the good faith belief of the individual or entity submitting the notice that the information and allegations contained therein are accurate and complete.
It is important that, when providing a sufficiently substantiated explanation or otherwise meeting the above required elements, you include all relevant facts and accurate references to the applicable law. This enables Trustname to properly assess the alleged illegality of the content.
Trustname will review each submission. However, under the DSA, Trustname is not required to conduct a detailed legal examination (Article 16.3) or perform independent fact-finding (Article 8).
Please note that certain situations may require a court determination. You may choose to obtain a ruling from a competent court applying applicable law. Any such court orders or findings may be included with your DSA report.
